Terms of Service

1. Acceptance of Terms
These Terms of Service (the "Terms") constitute a legally binding agreement between you and DRTAVIL LLC, an Illinois limited liability company doing business as Drift Maps ("Drift Maps," "we," "us," or "our") governing your access to and use of the website located at driftmap.us and all related pages, features, content, generated files, and services (collectively, the "Services"). By accessing or using the Services, creating an account, or making a purchase, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services. You represent that you are at least 13 years of age and, if you are under the age of majority in your jurisdiction, that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of the Services
The Services allow users to select real-world roads and locations and to receive computer-generated track files ("Tracks") intended for use with the Assetto Corsa racing simulation software. Tracks are produced by automated processes from third-party map, elevation, and imagery data. Drift Maps is an independent service and is not affiliated with, endorsed by, or sponsored by Kunos Simulazioni, 505 Games, or any owner of the Assetto Corsa trademarks, or by any owner or operator of any road or location depicted in a Track. You are solely responsible for obtaining and maintaining a lawful copy of Assetto Corsa and any other software required to use a Track.
3. Accounts
Certain features of the Services require an account. You agree to provide accurate and complete information, to maintain the security of your account and any sign-in links sent to your email address, and to notify us promptly of any unauthorized use. You are responsible for all activity that occurs under your account. We may suspend or terminate any account at our discretion, including for violation of these Terms.
4. Purchases, Subscriptions, and Automatic Renewal
Certain Services are offered for a fee, either as one-time purchases or as recurring subscriptions, at the prices and with the allowances displayed at the time of purchase. Payments are processed by our third-party payment processor, and you authorize us and our processor to charge your selected payment method for all applicable fees and taxes. Subscriptions renew automatically at the end of each billing period at the then-current rate, and your payment method will be charged accordingly, unless you cancel before the renewal date. You may cancel a subscription at any time through your account; cancellation takes effect at the end of the then-current billing period, and you will retain access to paid features until that time. We may change prices or plan features upon notice, with any price change taking effect at your next renewal. Unused allowances, credits, or builds do not roll over between billing periods unless expressly stated at the time of purchase, have no cash value, and are non-transferable.
5. Delivery and Nature of Tracks
Tracks are generated automatically and are delivered electronically, typically by making the Track available for download and notifying you by email. Delivery times are estimates only. Because Tracks are derived from third-party data sources that may be incomplete, outdated, or inaccurate, Drift Maps does not represent or warrant that any Track will be an exact or complete reproduction of any real-world road or location, that any particular feature, structure, surface, elevation, or scenery will be included or accurately depicted, or that any Track will perform in any particular manner within Assetto Corsa or in combination with any modification, content, or hardware.
6. Refunds and Rebuilds
If you are not satisfied with a purchase, you may request a full refund within seven (7) days of the date of that purchase by contacting us as set forth in Section 16. Each purchased build includes one (1) free rebuild of the same road upon request. Refund requests made after the seven-day period, and any additional rebuilds, are granted or denied at our sole discretion, except where a refund is required by applicable law. Refunds are issued to the original payment method. We reserve the right to refuse refunds in cases of abuse, including repeated or fraudulent refund requests.
7. License to Use Tracks
Subject to your compliance with these Terms and payment of all applicable fees, Drift Maps grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Tracks delivered to your account for your personal, non-commercial use, including on multiplayer servers that you host or play on. Except as expressly permitted by these Terms or as otherwise agreed by us in writing, you may not sell, resell, rent, sublicense, publish for download, or otherwise distribute any Track or any portion thereof, or represent any Track as your own work. All rights not expressly granted in these Terms are reserved by Drift Maps and its licensors.
8. Third-Party Data and Attribution
Tracks and other content made available through the Services incorporate or are derived from third-party data, including map data from OpenStreetMap contributors, which is made available under the Open Database License (ODbL), as well as elevation and imagery data from various public and commercial sources. Such data remains subject to the terms of its respective licensors, and your use of any Track is subject to those terms to the extent applicable. Drift Maps makes no representation regarding the accuracy, availability, or continued licensing of any third-party data.
9. User Content
You retain ownership of the content you submit to the Services, including road requests, messages, and posts in community areas ("User Content"). By submitting User Content, you grant Drift Maps a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, display, and distribute such User Content in connection with operating, improving, and promoting the Services, including building and publishing Tracks of roads you request. You represent that you have all rights necessary to grant this license and that your User Content does not violate these Terms or any applicable law.
10. Acceptable Use
You agree not to, and not to permit any third party to: (a) use the Services in violation of any applicable law or regulation; (b) access or attempt to access the Services by any automated means, including scrapers, bots, or scripts, except as expressly permitted by us; (c) interfere with, disrupt, or impose an unreasonable load on the Services or their infrastructure; (d) attempt to circumvent any payment, allowance, or access control; (e) reverse engineer, decompile, or otherwise attempt to derive the source code or generation methods underlying the Services, except to the extent such restriction is prohibited by law; (f) submit User Content that is unlawful, infringing, harassing, defamatory, obscene, or otherwise objectionable; or (g) use the Services or any Track to plan, promote, or facilitate any unlawful or dangerous activity on public roads. The Services are intended solely for simulated driving. Nothing in the Services is intended to encourage, and you agree not to engage in, drifting, racing, or any unsafe or unlawful driving on real roads.
11. Intellectual Property
The Services, including all software, generation methods, designs, text, graphics, logos, and other materials, and all intellectual property rights therein, are and shall remain the exclusive property of Drift Maps and its licensors. The Drift Maps name and logo are trademarks of Drift Maps and may not be used without our prior written permission. Nothing in these Terms transfers to you any ownership interest in the Services or any Track.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services and all Tracks are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade. Drift Maps does not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that any Track will meet your requirements or expectations.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Drift Maps or its owners, affiliates, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or use, arising out of or relating to these Terms or the Services, whether based on contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amounts you paid to Drift Maps in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case the foregoing limitations apply to the fullest extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Drift Maps and its owners, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Services or any Track, (b) your User Content, or (c) your violation of these Terms or of any law or the rights of any third party.
15. Termination; Changes; General
We may suspend or terminate your access to the Services at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, to us, or to third parties. Upon termination, the license granted in Section 7 shall terminate, except as to Tracks you have lawfully purchased and downloaded prior to termination for which no refund has been issued. Sections 6 through 16 shall survive any termination. We may modify these Terms from time to time by posting the revised Terms on the Services and updating the effective date above; your continued use of the Services after such posting constitutes acceptance of the revised Terms. These Terms shall be governed by the laws of the State of Illinois and applicable federal law of the United States, without regard to conflict-of-law principles, and any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Illinois, except where the mandatory consumer protection laws of your country or state of residence provide otherwise. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Drift Maps regarding the Services. You may not assign these Terms without our prior written consent; we may assign them without restriction.
